The Dearie Law Firm, P.C. cares about the health of our staff, clients and the community and are committed to health and safety as we navigate the COVID-19 pandemic.  As parents, children, brothers, sisters, friends, neighbors, we understand just how stressful this time really is.  It is with this understanding that we want to emphasize that nothing is more important to us than the health and safety of our staff, clients and community.  Effective immediately, we are continuing operations remotely with a team who remains is dedicated to accomplishing our mission.

Injured Workers Can Often File Both

When a worker is injured on a construction site job, eligibility for a Third Party Negligence Suit and a Worker’s Compensation Claim are frequently both available.

Construction Site Lawsuit/Workers’ Compensation Claim Injured Workers Can Often File Both

A Third Party Suit means the negligent party is other than his/her employer; therefore can be sued provided the lawsuit is filed within three years of the accident date. Shorter filing time periods apply, if a Government at any level, is the named Defendant.

A Worker’s Compensation Claim is always available to any injured worker, if the accident occurred in a workplace setting, while the worker was performing assigned tasks. A very key distinction in the Worker’s Compensation Program is that no requirement exists to prove negligence by any person or entity in the Claim. The Worker’s Compensation Application must be sent in writing to the Employer within thirty days of the accident date, or within thirty days from a death occurring from the workplace. Currently, the maximum weekly WC Award total $964.

Think about these startling statistics – – In 2017, (last year of data) 47,600 opioid overdose deaths, (averaging 130 a day) constituted 68% of all overdose deaths in the United States, with New York, New Jersey, Connecticut and Pennsylvania among 23 states with the highest rates of drug overdose deaths.

Opioid exposure tends to occur in a highly repetitive pattern, as workers are injured on the job, visit a doctor, who prescribes (often over prescribes) opioid pain management pills, dosages increase resulting in workers suffering opioid addiction.

Recently, in Oklahoma, a Judge determined against Johnson & Johnson (the giant pharmaceutical manufacturer) guilty of fueling the state’s opioid crisis, ordering the health-care company to pay $572 million. As a result of this Decision, States, Cities and Counties will be reimbursed for medical costs associated with workers’ treatment.

Our Firm is legally researching whether a Cause of Action by individuals, as contrasted to governments, can be brought against over prescribing physicians and opioid drug manufacturers. Such individual lawsuits would parallel the tobacco litigation of decades ago.

Consider what these potential personal injury cases have in common—-tripping on a subway station floor defect; struck in one’s car by a state police motor vehicle or suffering medical malpractice during a municipal hospital stay.

Each plaintiff’s common factor shows the defendant is a governmental entity (MTA, State, City respectfully) requiring that a “Notice of Claim” must be submitted within 90 days of the accident prior to filing a lawsuit. Failure to file a “Notice” timely prevents commencing a lawsuit although some exceptions may apply.

The Notice must contain in writing the date of injury, how the accident occurred and other facts to establish that a viable cause of action against the government exists.

The primary lesson remains that every injured person should seek legal advice quickly after an accident as delays are often legally very costly.

In July 2019, President Trump signed into law the Never Forget the Heroes: James Zadroga, Ray Pfeifer, and Luis Alvarez Permanent Authorization of the September 11th Victim Compensation Fund Act. This legislation extends VCF’s filing deadline to 2090 and ensures that the VCF is fully funded and will remain permanently open for those who become ill in the future due to toxic exposure after 9/11.

Five months prior to passage of the Permanent Authorization Act, VCF Special Master Rupa Bhattacharyya had announced that VCF was running out of money and would be unable to pay all pending and anticipated claims.

And so the legislative targets were clear—extend the VCF and secure funding for future claims. Enter John Feal, the highly effective lobbying advocate, who descended daily for months on congress and the White House with his tireless band of victim responders. With astounding lobbying effectiveness, aided significantly by TV celebrity Jon Stewart, the legislative goals were achieved with the VCF extended for decades and $10.2 billion approved for claim award payments.

Our firm was actively and financially in support of the successful lobbying work on behalf of thousands exposed workers and volunteers.

This new law guarantees that VCF will have sufficient funding to pay all monetary awards for the next 70+ years with initial authorized funding of $10.2 billion. To be eligible for financial compensation from the VCF, an individual must have been: 1) Exposed to the 9/11 toxic environment between September 11, 2001 and May 30, 2002; and 2) Diagnosed with one of VCF’s covered conditions.

The 9/11 toxic environment includes the area in Manhattan south of Canal Street and any areas related to the routes of debris removal, including Fresh Kills landfill and municipal bus depots. The medical conditions that are covered by VCF include all forms of cancer, as well as certain respiratory and digestive non-cancerous conditions.
